CHICHESTER BOARD OF ADJUSTMENT
NOTICE OF DECSION

Case #196-Selectmen appealing the Administrative Decision of the Building Inspector for a permit issued to Teresa & Gerald Paradis/Live & Let Live Farm, Map 1 Lot 28, to construct a riding arena in a residential district according to Article II, Section D of the zoning ordinance has been granted by a vote of 4-1 on March 29, 2006.

It was moved and seconded to rescind the building permit for a riding arena on Map 1 Lot 28 owned by Gerald & Teresa Paradis/Live & Let Live Farm dated 2/3/06 for the following reasons:
  The Building Inspector did make some mistakes, but two wrongs don’t make a right.
  The land owners and Live & Let Live Farm Board of Directors were aware of possible zoning violations since November 2005.
  They appear to have ignored the request for discussions until after the building permit was requested.
  They did not make the Building Inspector aware of these issues before requesting a building permit

Motion carried 4-1.  Building permit is rescinded.

Note:  The Selectmen, any party to the action or any person directly affected has a right to appeal this decision within 30 days from the date the decision was made.  See NH RSA, Chapter 677, available at the Selectmen’s Office.  This notice has been placed on file and made available for public inspection in the records of the BOA on 4/3/06.  Copies of this notice have been distributed to the applicant, Planning Board, Selectmen, Town Clerk and Building Inspector.
